BTOA Connect Driver Terms and Agreement of Use

TThese Terms and Agreement of Use (“Agreement”) set forth the terms under which licensed taxi operators, who are members of the Bermuda Taxi Owners and Operators Association (BTOA), may access and use the BTOA Connect mobile and web application (“BTOA Connect App” or “Platform”).

By accessing or using the BTOA Connect App, you (“Operator” or “Driver”) agree to comply with this Agreement, the Motor Taxi Act 1976 (and any amendments or related regulations), Road Traffic Act 1947 (and any amendments or related regulations), the Personal Information Protection Act 2016 (PIPA), and any other applicable laws of Bermuda.

1. Eligibility and Membership

1.1 Use of the BTOA Connect App is limited to current BTOA members in good standing.

1.2 Operators must hold a valid Public Service Vehicle (PSV) license and operate a taxi registered with the Bermuda Transport Control Department (TCD).

1.3 The App is currently in BETA version, and may contain limited features, subject to improvement and update.

2. Independent Contractor Status

2.1 Operators using the App act as independent contractors, not employees, partners, agents, or representatives of BTOA or BTOA Connect.

2.2 Operators are solely responsible for the transportation services they provide and must comply with all statutory and regulatory requirements, including insurance and licensing.

3. Operator Responsibilities

3.1 Operators agree to::

  • Deliver services in a safe, professional, and courteous manner;
  • Only use the registered vehicle listed in their BTOA Connect profile.
  • Accept and complete transport jobs using the Government-approved taxi meter’s
  • Charge fares in accordance with Government-regulated rates;
  • Maintain confidentiality of all personal, commercial, and customer data accessed through the app.

3.2 Operators shall not:

  • Share login credentials or access to the app with third parties;
  • Take screenshots or publicly share internal app content or job listings;
  • Post BTOA Connect job details in chat groups or other digital forums.
  • Subcontract or delegate assigned jobs to non-approved drivers.

Violations of these terms may result in immediate removal from the platform and reporting to the TCD.

4. Job Dispatch and Completion Process

4.1 Jobs may be dispatched via:

  • Customer Web Portal,
  • Stakeholder platform (corporate accounts),
  • BTOA Connect HQ,
  • Self-dispatch by the Operator.

4.2 Standard Job Workflow:

  1. The job is posted on the App and made visible to eligible Operators.
  2. The operator accepts the job in-app.
  3. Customer is notified via app, SMS, and/or email.
  4. The operator contacts the customer to confirm pick-up.
  5. Upon arrival, the Operator starts the trip in the App and activates the Government-approved meter.
  6. The operator completes the drop-off and ends the trip in the App.

Note: There is currently no digital or credit card payment functionality in the app.

5. Cancellations and Job Reassignment

5.1 Operators who cannot complete a job they have accepted must:

  • Return the job to the dispatch pool in-app, or
  • Notify BTOA Connect HQ for manual reassignment.

5.2 Stakeholders cancelling a job must notify BTOA Connect HQ within 5 minutes of cancellation.

5.3 If a stakeholder fails to cancel a job properly, the stakeholder must report the issue to HQ.

Direct contact with stakeholders regarding disputes is strictly prohibited. All complaints must be routed through BTOA Connect HQ.

6. Data Privacy and Personal Information (PIPA Compliance)

6.1 Data Collection & Use

BTOA Connect collects, stores, and processes personal information from both Operators and customers to facilitate taxi dispatch services. This includes:

  • Customer names, pickup/drop-off locations, and contact information;
  • Operator names, vehicle details, license numbers, and trip logs.

6.2 Legal Basis

All personal data handling complies with Bermuda’s Personal Information Protection Act 2016 (PIPA). Data is collected and processed lawfully, fairly, and with the minimum intrusion necessary to deliver the intended services.

6.3 Data Sharing with Operators

Upon accepting a job, Operators will receive the necessary customer details such as:

  • Pickup and drop-off addresses;
  • Customer name and phone number;
  • Any additional job instructions?

This data is shared exclusively to fulfill the transportation service. It must not be used for any other purpose or retained beyond the completion of the job.

6.4 Operator Data Privacy Obligations

Operators must:

  • Treat all customer data as confidential.
  • Do not record, reproduce, or share personal information outside the job context.
  • Immediately delete or destroy any customer data stored on their devices after completing a job.
  • Report any suspected data breach or unauthorized access to BTOA Connect HQ within 24 hours.

Breach of PIPA obligations may result in:

  • Termination of platform access.
  • Legal liability under Bermuda law;
  • Reporting to the Privacy Commissioner for Bermuda.

7. Platform Security

BTOA Connect uses secure authentication, data encryption, and role-based access controls to protect personal information. Operators are responsible for:

  • Using strong, confidential passwords;
  • Ensuring their mobile devices are secure and not accessed by unauthorized individuals;
  • Not attempting to bypass or disable app security features.

8. Enforcement, Suspension, and Reporting

8.1 Operators who violate any provision of this Agreement, the Motor Taxi Act, the Road Traffic Act 1947, PIPA 2016, or related regulations will be subject to:

  • Suspension or permanent removal from the BTOA Connect platform & BTOA;
  • Reporting to the Transport Control Department or relevant authorities;
  • Potential civil or criminal proceedings, where applicable.

8.2 BTOA reserves the right to audit driver conduct and usage of the App at any time for compliance purposes.


9. Limitation of Liability

BTOA Connect provides a platform for matching taxi services with riders. It does not assume liability for:

  • Lost or damaged property during rides.
  • The conduct or safety of independent Operators;
  • Any accidents, injuries, or legal claims arising from taxi services.

Operators and stakeholders accept full responsibility for actions conducted while using the App and during transport.

10. Modifications

This Agreement may be updated from time to time to reflect operational changes, regulatory updates, or PIPA compliance measures. Operators will be notified of any material changes, and continued use of the platform implies acceptance of the revised terms.

11. Governing Law

This Agreement is governed by the laws of Bermuda, including:

  • The Motor Taxi Act 1976;
  • The Road Traffic Act 1947;
  • The Personal Information Protection Act 2016 (PIPA).

Any disputes will be subject to the jurisdiction of the courts of Bermuda.

12. Governing Law

By logging into and using the BTOA Connect App, the Operator certifies that they:

  • Have read and understood this Agreement;
  • Will comply with all legal obligations, including PIPA;
  • Accept full responsibility for services provided through the platform.
